Terms of sale

1. Objet

These terms govern the website design, development and support services provided by Agence Web Premium, an agency established in Gueliz, Marrakesh (Morocco). Any order implies their unreserved acceptance.

2. Quote and contract formalities

Every project is subject to a written, free quote specifying the scope, features, languages, deadline and price. The contract is formed upon receipt of the signed quote and payment of the deposit. A verbal agreement, a WhatsApp exchange or a validation message does not constitute acceptance of the quote.

3. Prices and payment terms

Applicable prices are those of the accepted quote. Our public rates are dated and displayed. Payment is made by deposit at ordering and balance on delivery, per the schedule on the quote. Any out-of-scope work is subject to a priced amendment accepted before execution.

4. Deadlines

Deadlines run from receipt of the deposit and of all necessary elements: texts, images, technical access and approvals. Any delay attributable to the client shifts the schedule accordingly. The announced deadlines — 7 days for a showcase site, 14 days for a business site, 21 days for a custom site — are contractual once they appear on the quote.

5. Obligations du client

The client undertakes to provide the requested content within the agreed deadlines, to designate a single contact authorized to validate the stages, and to warrant that they hold the rights to the texts, images and trademarks sent to the agency.

6. Obligations d'Agence Web Premium

We undertake to perform the service in accordance with the quote, to inform the client of any difficulty encountered, to deliver a functional and tested site, and to provide the onboarding training specified in the quote.

7. SEO and results

Agence Web Premium does not guarantee any position on search engines. No provider controls Google's rankings. We commit to the work delivered — page structure, speed, markup, content, structured data, Google Business Profile listing — not to a rank, a traffic volume or revenue. Basic SEO is included with every project; position tracking is a separate support service.

8. Money-back guarantee

If the mockup presented does not match the scope described in the quote, the client may request the project to be stopped and the deposit refunded. Once the mockup is validated, the service is considered engaged.

9. Intellectual property and delivery

After full payment, the client owns the delivered site, its source files and its content, excluding reusable elements belonging to Agence Web Premium or to licensed third parties. The domain name is registered in the client's name, who retains control of it and responsibility for its renewal.

10. Hosting, maintenance and liability

Hosting and the domain name are taken out in the client's name and remain their responsibility. Twelve months of follow-up are included from go-live. Agence Web Premium cannot be held liable for interruptions attributable to the host, changes made by the client or a third party after delivery, or consequences of use inconsistent with the site's purpose. Its liability is in all cases limited to the amount actually paid for the service concerned.

11. Droit applicable

These terms are governed by Moroccan law. In the event of a dispute, the parties first seek an amicable solution, then the competent court of Marrakesh is seized.
